साइबर लॉयर इन इंडिया :
आज साइबर कानून ,डिजिटल दुनिया का सबसे बड़ा हिस्सा होगया है । जो इंटरनेट ,साइबर स्पेस , और सारे साइबर मामले से संबधित है। साइबर कानून को समानय भाषा में “इंटरनेट का कानून ” कहा जाता है ।
आज ,कंप्यूटर डिवाइसेस को बड़े गोपनियता से डाटा स्टोर करने में यूज किया जाता है। इससे आपके कीमती डाटा को धोखाधड़ी और साइबर अपराध से बचाया जा सकता है। इंटरनेट के युग में आपका पैसा जेब में वर्चुअल तरीके से रहता है। आप इसी माध्यम से पूरी दुनिया में अपना पेमेंट ट्रांसफर करते है। लेकिन आपको यह नहीं पता होता है की आपके और सामने वाले के बिच में तीसरा कोण बैठा हुआ है ! और इसी के कारण से आप साइबर क्राइम के शिकार हो जाते है। आज दिन पर दिन इसकी तेजी दिखाई दे रही है। कई प्रकार कई साइबर क्राइम होते है जैसे :-
१)ऑनलाइन तंग करना (साइबर हरेसमेंट ) : आज कई युग में बैंक अकाउंट तो काम ,लेकिन सोशल मीडिया अकाउंट जयादा मेन्टेन करते है लोग । लेकिन साइबर क्रिमनल्स न जाने कितनी फेक आईडी बनाकर लड़के हो यह लड़की को परेशान करते है। और इसी कारण लोग कई कई बार गलत फैसले ले लेते है या सबसे छुपा लेते है । इस तरह कई फ्रॉड से बचने कई लिए हमारे लिए “साइबर कानून ” बनाया गया है, जिसमे धारा-66 (ए) के अंतर्गत जेल और जुर्माना दोनों भोगना पड़ता है।
२) डाटा की चोरी (डाटा थेफ़्ट): अगर आपका कोई डाटा चोरी करता है तोह उसको साइबर कानून की धारा – 43 (बी) ,धारा -66 (इ),धारा – 67 (सी), और आईपीसी की धारा -379 ,405 और 420 कई अंतर्गत अपराध दर्ज करके उसकी गहराई कई हिसाब से जेल और जुर्माना सपा जाता है ।और भी अन्य प्रकार के साइबर कानून की धारा के अंतर्गत साइबर क्राइम दर्ज किये जाते है ।
साइबर क्राइम के तहत साइबर न्यायपालिका यानि, साइबर लॉयर की आवश्यकता बढ़ रही है। क्योकि आज साइबर लॉ का नॉलेज हर किसी को नहीं होता है। भारत में रोज 3000 से भी जयादा साइबर कई मामले बनते है , और जिनकी सुनवाई भी बहुत पेंडिंग है । इससे में साइबर लॉ और साइबर एक्सपर्ट की जरुरत होती है पुलिस के साथ । इसी तरह से ठगी और अन्य साइबर क्राइम को रोक पाएंगे ।
साइबर लॉ में 18 -५० साल तक का कोई भी व्यक्ति अपना भविष्य इस फीलड में बना सकता है। अगर आप बारहवीं पास है तोह आप “डिप्लोमा इन साइबर लॉ” और साथ में”आईटी कोर्स ” कर सकते है। अगर आप ग्रेजुएट है तोह आप “पीजी डिप्लोमा इन साइबर लॉ एंड आईटी ” कर सकते है। अगर आप एलएलबी करे हुए तोह इससे सुनहरा और कोई अवसर न होगा , आप 1 साल का डिप्लोमा या एलएलएम कर सकते है और केस लड़ सकते है ।
आने वाले समय में साइबर लॉ के विशषज्ञ बनने का सबसे सबसे बड़ा अवसर अभी से है, की आप इन छोटे कोर्स करके आप बड़े साइबर लॉयर बन सकते है । आने वाले समय में टेक्नोलॉजी कई बदलने से साइबर क्राइम में भी बढ़ोतरी होगी । तो हमें आज से ही इसके लिए इससे तैयार होना होगा की इस तरह कई क्राइम शून्य पर आकर टिक जाए , और सबको न्याय मिले ।
तो आइए, हम सब मिलकर साइबर अपराधों को रोकते है और अन्य देश वासियो को भी जागरूकत करते है ।ताकि इसका शिकार कोई भी न हो ।

In India, Cyber law is codified in a very well manner. But the implementation of the same is not made effectively. Like the cases were not heard at time and the trial is very slow. Because of this many people prefer to ignore some minor offences. The benefit of the law will only be gain when the implementation of the same is done properly and people will be made aware of the same through advertisement and by conducting campaign seminars and also promotion by government also.
Due to the narrow scope of cyber law,many of the law students did even know about this branch of law. To improve this and keeping in mind the future scenerio as surely with the developing society these crimes are going to rise in future, the subject of cyber law shoulb be introduced in law schools in under graduate courses.
This article by far is helpful in creating awareness among the law students about the cyber lawyer scope.
